In accordance with the Associations Incorporation Reform Act 2012 (Vic) (the AIR Act), UMGSA operates under a set of rules that it calls a Constitution. The purpose of this document is to provide GSA members (including GSA Board, Representative Council Members and Faculty Council Members) with an overview of the key provisions of the Constitution as well as their general duties and responsibilities.
The Constitution of UMGSA forms a legal contract and is binding on UMGSA, the GSA Board members and the Members. It is important that GSA Board members understand the Constitution and take care to operate within its requirements (as well as the requirements of any Regulations made under the Constitution). Both UMGSA and any Member of UMGSA can apply to the Magistrates’ Court for an order to enforce the terms of the Constitution. In addition to this, failure to comply with the requirements of the Constitution may place UMGSA in breach of the ACNC Governance Standards.
